Terms of Use for Private Sellers

Below, you will find the 'terms of use for private sales to Newcop’. We recommend reading them carefully. By registering as a private seller on Newcop, you accept and comply with these terms of use and all appendices.

  1. Each Private Seller must register as a seller before being able to offer and sell products to Newcop
  2. Registration as a Private Seller implies acceptance of the Terms of Use, including all appendices and, to avoid misunderstandings, explicitly includes the Private Seller Manual and the obligation to comply with the Terms of Use.
  3. To act as a Private Seller, the Private Seller must:
    • Have registered on Newcop as a private seller
    • Confirm that the Terms of Use have been accepted
  4. The Private Seller is only authorized to register once, and may only sell products they own
  5. The Private Seller is fully responsible at all times for the use of their name and surname. Newcop is authorized at any time to suspend the use of the Account by the Private Seller for its own reasons.
  6. The Private Seller may not allow others to use their name
  7. The Private Seller is responsible for the accuracy of the information in their Account.
  8. The Private Seller may only offer genuine Products. The Products must meet the series of conditions established in the Private Seller Manual.
  9. The Private Seller will check their email to promptly take note of information received from Newcop.
  10. The Private Seller will use the shipping label provided by Newcop to send the order. The Private Seller will print this shipping label on white paper and will not make any changes to it.
  11. Newcop does not disclose customers' personal data to the Private Seller
  12. Newcop does not disclose the Private Seller's personal data to Customers.
  13. The Private Seller explicitly agrees and grants Newcop permission to retain, view, and use communications made by email and chat.
  14. The Private Seller declares and guarantees that they have the right to accept and comply with these Terms of Use, as well as with the Private Seller Manual and to grant the rights granted by this document.
  15. The Private Seller guarantees that:
    • Only products offered will be in the product categories opened by Newcop;
    • The products offered have never been used and are genuine
    • The products offered are their property, the offer is not misleading or violates applicable laws and regulations, they are authorized to offer these Products for sale and to sell them, and the Products offered are always original Products, not imitation products;
    • The products are not defective;
    • The products offered and the information provided do not violate any rights (such as, among others, intellectual property rights);
    • The acts of the Private Seller and/or the Private Seller’s Products will not harm the reputation and/or good name of Newcop or the Environment;
    • They act in accordance with the Terms of Use, the Private Seller Manual, the general conditions for purchasing from other sellers, as well as all applicable laws and regulations;
    • They always act according to the guidelines and instructions of Newcop.
  16. The Private Seller will hold Newcop harmless against all damages arising from claims against Newcop as a result of breach of the warranties in this article.
  17. The Private Seller acknowledges that all rights (intellectual property rights) related to the Environment, design, Content, and all trademarks and logos of Newcop are and remain the property of Newcop and may not be used in any way by the Private Seller without prior written consent from Newcop. The Private Seller will always respect the intellectual property rights and all other exclusive rights of Newcop and third parties.
  18. Newcop is authorized at any time to cease making the functionalities of the Private Sale Contract available.
  19. The Private Seller may not claim any compensation from Newcop in relation to the termination of the Private Sale Contract by Newcop, and the Private Seller hereby waives any right to compensation.
  20. The Private Seller is responsible for the return costs of all Products they wish to recover.
  21. The Private Seller fully indemnifies Newcop against all damages and/or costs of any kind arising from breach of one or more obligations under these Terms of Use.
  22. Newcop is authorized to modify these Terms of Use and the Private Seller Manual at any time. The amended Terms of Use and/or Private Seller Manual will take effect immediately upon publication in the Environment. If a Private Seller continues selling under their name thereafter, they accept by this act the applicability of the amended Terms of Use and/or Private Seller Manual. Therefore, it is advisable to consult the Terms of Use and the Private Seller Manual before using the Account. If the amended Terms of Use and/or Private Seller Manual are not acceptable to the Private Seller, the Private Seller is authorized to terminate the Private Sale Contract.
